They're still at it. Sony (SME) content ID'd a public domain video of Apollo 8, then rejected my dispute. I'm appealing.


Title really says it all. SME is still deliberately making false claims of ownership over videos that don't include any of their content. In this case, it was likely triggered by a Content ID match that failed to exclude their own inclusion of third-party public domain video from NASA.This Apollo 8 video in particular is the one I incorporated into my broadcast. To note, it wasn't full screen - it was split screen with me, and I was talking over the video with commentary. But again, it's public domain, so that really doesn't matter at all.What gets me is that they claim to review the dispute and still assert copyright. I blame YouTube for that. YouTube should incorporate language to make it a breach of contract to knowingly provide false responses or to use a negligent review process. And breach of that contract should have financial teeth to it. Sure, SME has expensive lawyers, but so does Google. It's time Google stood up for the users.Undeterred by the threat of a copyright strike, I appealed their rejection, with the following language.The third-party content in the referenced portion of my video is public domain from NASA. It can be found at (https://go.nasa.gov/2isHEt4) and (https://www.youtube.com/watch?v=ToHhQUhdyBY).Further, it is a historic video that is well known, and so it is hard to see how this could be an honest mistake. Even the briefest of legitimate review would have made this fact obvious. I will be sending a letter to NASA's legal department to inform them that SME is illegitimately claiming exclusive ownership of their content. I believe the government frowns on that sort of thing.On a technical note, this false "ID" match is likely due to SME failing to exclude third-party content as required by YouTube to use the Content ID system. (http://bit.ly/2DqSJDV) I will attempt to find a contact at YouTube to bring this violation of their Content ID guidelines to their attention.Finally, if SME again rejects this appeal and causes further harm to my YouTube account based on false information, I reserve the right to exercise my legal rights to their fullest extent, including but not limited to seeking damages. Thank you.So, if there's anyone here from YouTube that wants to help me make good on that last part, about contacting someone at YouTube to make them aware of SME's failure to follow Content ID guidelines (and basic human decency) then please let me know you're aware and are taking action. via /r/youtube
